Cooperation:
P8N Media wants to ensure that all parties, including the videographer, assistants, bridal party, etc., are happy and cheerful on the day of the wedding. We want to ensure that everything goes smoothly. P8N Media is not to be held responsible if desired parties do not cooperate or appear when expected to do so.
Images:
We encourage expression of personal preferences, but ask that the client understands that total artistic expression, including editing and methods of photography, is to be decided by P8N Media. We will
produce as much of the footage as possible in the allotted hours of shooting, however, P8N Media will not deliver all of the photos taken. Photos will be returned to the couple no later than the longest date chosen on delivery prefrences (Standard, Priority, Express or Same Day.
Exhibition & Model Release:
By signing this agreement, the client gives P8N Media the permission to use the wedding photos in advertising, competitions, and any other
venue where the photographer sees fit. The client releases and realizes that any profits made by the photographer with these photos, belong solely to P8N Media.
Food & Beverage Breaks:
P8N Media requests that photographer is fed same meal as attendees and given breaks when deemed appropriate by all parties.
Venue Information:
Please notify the videographer of any house rules they are to abide by. (Ex: no flash). The client must understand the implications of any restrictions by the venue.
Images & Copyrights:
Video produced by P8N Media are property of the videographer. Only after full payment is received and processed (if paying with a check) will the client receive the link to the edited footage. At the time of full payment, the client is given full permission to post photos online wherever they see fit. P8N Media strongly suggests that no further editing be done to the photos. The final images have already been processed and edited to their full potential. The client also is urged to tag the videographer in any posts made on social media sites when displaying the original photos.
Limit of Liability:
In the unlikely event that P8N Media becomes injured or too ill to attend, responsibilities and liabilities are limited to the photographer returning the payments made by the client thus far. In the very unlikely event that images are lost, stolen, or destroyed for whatever reason, P8N Mediaʼs liability is limited to the return of the payments received.
Mass illness/Pandemic/Government Restrictions:
P8N Media will do everything in our power to protect you and your guests, as well as ourselves from potential illness. By signing this contract, the contracted party and their affiliates release P8N Media and his associates of responsibility if we were to make others sick. P8N Media will not be held liable or assume responsibility for acts of God or government issued mandates that affect the agreed upon date of wedding activities. This includes, but is not limited to, natural acts of destruction, man-created hindrances and nuisances, pandemics, wide spread illness or the threat thereof, or government issued mandates or limitations on guest counts, gatherings, or postponements of social groupings. Payton will work with couples if a postponement is needed. If a date can be agreed upon, no extra rescheduling fees will be added to the balance. The new date will be agreed upon in writing. If a new date cannot be settled upon by both the couple and the photographer, any payments collected after the retainer will be refunded. The retainer fee is non-refundable at any time for any reason.
Failure to Perform:
If Payton is unable to perform this agreement due to illness, emergency, fire, casualty, strike, unsafe environment, threat, act of God or causes beyond the control of the photographer, the photographer will not be held liable for missing scheduled session coverage. P8N Media will arrive to the wedding at the best of their abilities. If coverage services cannot be fulfilled by P8N Media, or a replacement chosen at the discretion of the photographer, photographer shall return the retainer to the client and shall have no further liability. Further, if the videographer is unable to deliver materials due to technological malfunctions, including but not limited to camera and processing or otherwise lost or damaged without fault of the videographer, liability shall be limited. The limit of liability shall not exceed the contract price. P8N Media will not be held responsible for any ruined clips due to guests’ (or any other) flashes; or any other cause in or outside of P8N Media's control.
Substitute photographer:
The photographer reserves the right to substitute with another photographer in the case of failure to perform as stated above. The substitute photographer is chosen at the discretion of P8N Media and does not constitute a breach of this agreement. The photographer warrants the substitute photographer to be of comparable quality and professionalism.
Payment Schedule:
One fourth of the total package is due upon signing of the contract. This will secure your booking with P8N Media. The remainder of the balance is due no later than one week before the wedding. The retainer is non-refundable at any time, for any reason. Re-edits if deemed appropriate by P8N Media will be processed as an hourly fee of $100.00 for edits will be billed with a minimum one hour required. Client will have seven (7) days after edited photo delivery to make P8N Media aware of any issue, discrepancy, technical problem or any other complaint regarding videos. After this seven day term has expired, P8N Media will no longer be liable for any corrections, damages, refunds, re-edits or re-shoots.
